Members present were Frank Burt, Jr., David E. Bishop, Charles F. Gruber and Wayne A. Gruenloh, Chairman.

Also present were Michael L. Thompson, County Administrator and J. Scott Barnett, Chief Counsel.

(E17) - I-10 SERVICE ROAD SUPPLEMENTAL AGREEMENT #1

On March 8, 2007, the Commission authorized the Chairman to sign an agreement between Baldwin County and Carter-Burgess, Inc. for the survey and design of an I-10 service road from SR-181 to the east property line of Cypress Equities with the terms of the agreement negotiated by the Highway Department and a contract amount not to exceed $526,199.00. Based upon present knowledge of the proposed project, the field survey and geotechnical investigation portions scope of work and fee have been revised.

Commissioner Burt asked if the scope of work includes work on private projects?

Cal Markert, County Engineer appeared before the Commission and said part of what the County is doing for the interchange for the Department of Transportation and the Federal Highway Administration, is evaluating the entire corridor from Highway 181 to Highway 98. The County is surveying and designing approximately two miles, west of the interchange, short of the Cypress Equities property, and going back east to the beginning of the pavement on Woodrow Lane.

Chairman Gruenloh asked if the County is doing any kind of design as far as the road the Cypress Equities is building in their project, in which Mr. Markert replied no. At one point the roads were going to be tied and Cypress Equities were going to have to redesign their section, and the County was working with them on that, but right now they are not. The County is surveying and gathering some field data so that if something does happen and the County can tie to the road, there is enough data to do that. The scope is wide because of the environmental document that has to be turned in.

Commissioner Burt said since the scope of work includes research on private property, Commissioner Burt wants it clarified that the County is doing this because of ALDOT’s requirements and therefore the Commission is not violating any laws by spending County funds to complete the work.

MOTION BY COMMISSIONER BURT, SECONDED BY COMMISSIONER BISHOP TO AUTHORIZE THE CHAIRMAN TO SIGN SUPPLEMENTAL AGREEMENT #1 BETWEEN BALDWIN COUNTY AND CARTER-BURGESS, INC. TO REVISE THE SCOPE OF WORK AND TOTAL FEE OF THE ORIGINAL SURVEY AND DESIGN CONTRACT FOR THE I-10 SERVICE ROAD. THE TOTAL CONTRACT FEE WILL BE REVISED FROM $523,844.00 TO $520,581.00.
