CITY COUNCIL WORK SESSION

COUNCIL MEMBERS PRESENT: Bailey Yelding; Cathy Barnette John Lake arrived at 6:35 p.m.; Greg Burnam; Ron Scott; Derek Boulware; August Palumbo.
Also present: Mayor Small; Rebecca Hayes, Assistant City Clerk; Jay Ross, City Attorney; Kim Briley, Finance Director; Bill Eady, Public Works Director; Tracey Miller, Solid Waste Coordinator; Ashley Campbell, Environmental Program Manager.
Absent: David Cohen, City Clerk.
I-10 Service Road
Council President Palumbo stated that the service road will connect U.S. Highway 98 with State Highway 181. The MOU with the County states that if construction does not begin by July 1, 2010 then the city’s commitment to pay $1,000,000 will expire. Council President Palumbo stated that the question is what does the word “construction” mean? Does it mean that contracts have been signed by July 1, 2010 or does it mean that actual work has begun by July 1, 2010.
Mr. Cal Market stated that the Highway 13 interchange was designed to work without the service road, but could be connected to service road later, but it is his opinion that if the service road is not built that the interchange will not happen.
Council is concerned with the road connecting two Spanish Fort shopping centers, and that since the hospital is not going to be built it will not benefit Daphne. The reason council committed to the project in the first place was that the hospital was coming to that area.
Mrs. Ashley Campbell, Environmental Program Manager, presented to council a mitigation plan with the county for D’Olive Creek. The county will hold the permit and do the work, and the city will help monitor the area, but the county will be liable for five years after the project is complete.
Historic Malbis wants to give the city a part of D’Olive Creek.
Mrs. Campbell stated that it would be easier to get grants to fix the creek if the city had ownership.
Mr. Market stated that the mitigation was not contingent on the service road.
Mrs. Campbell stated that the county could go to somewhere like Tuscaloosa and by credits and have no liability, but they want to stay in Baldwin County.
Mrs. Campbell stated that the stream mitigation project will be $250,000. All change orders and any cost over the $250,000 will be covered by the county.
Council asked questions of Mrs. Campbell and Mr. Market.
There was not a positive feed back from council on the stream mitigation.
Mrs. Campbell stated that she needed guidance from council on this issue.
Councilwoman Barnette stated that she would like to see this on the agenda with Ashley’s aspect with the agreement being specific that this was not contingent upon the service road.
Council President Palumbo asked that the papers be drawn up and submitted to Mr. Ross for review
