I don't have the luxury of a time traveling DeLorean but with the help of the online archives from Daphne City Council and Baldwin County Commission, plus any other documentation that the protagonists care to share with me,  I am attempting to piece together the exact sequence of events that led us to our current state of affairs. 

By documenting this in one place I hope people will be able to understand who really are the friends of TimberCreek and for all of us to recognize how easy it would have been to have our community destroyed before we knew what was going on.  Remember:

  • Elections have consequences.
  • Not taking an interest in your local city, county and state affairs has consequences.

This blog entry will serve as an index to the various meetings, workshops, discussions and news paper articles; the full details of each item can be read by clicking the date link.  Each item will be date stamped based on the real time of the event so that this blog becomes a chronological archive.

2005

January 4th 2005      Baldwin Commissioners receive Daphne's annexation ordinance 2004-37 and 38

Janury 18th 2005     Baldwin Commissioners ask ALDOT to build a service road based on Cypress Equities request.

March 1st 2005      Baldwin Commissioners discuss the service road.

May 2nd 2005     Daphne Council vote to hold Resolution 2005-34 (Support of the Service Road) pending more information.

May 17th 2005      Daphne Council still waiting for more information...

June 6th 2005      Daphne Council still waiting...

July 28th 2005      Daphne Planning Commission approve TimberCreek Phase 10A (31 lots)

October 11th 2005      Baldwin Commissioners discuss road development priorities before meeting Congressman Bonner.

November 22nd 2005      Annex Petition from TimberCreek Land Co.

December 22nd 2005       Mr. Allen Cox asks Daphne Planning Commission for B2 zoning of the annexed property.

December 28th 2005       Memo to Daphne Council re Annexation of the rest of TimberCreek into the City with a B-2 zoning.

2006

January 3rd 2006      Daphne set a public hearing for the annex.

January 31st 2006      Gus Palumbo raises concerns about the zoning

February 6th 2006      Public Hearing

February 20th 2006      Daphne Ordinance 2006-07 Annexation of TimberCreek Property:  Carried Unanimously.

March 2nd 2006      Baldwin Commissioners accept the Ordinance

May 2nd 2006      Commissioner Bishop sets a public hearing for the Highway 13 Interchange

May 25th 2006      Daphne Planning commission review a re-zoning request from TimberCreek Land Co.

May 31st 2006      A Memo to Daphne Council advising of affirmative recommendation of the re-zoning

July 17th 2006      TimberCreek Land Co. change their minds and withdraw the rezoning application

August 24th 2006      Baldwin Commissioners discuss the Interchange and Service Road Projects

2007

January 2nd 2007      Daphne Council Resolution 2007-02 Support for Service Road.  Motion Carries despite Gus Palumbo's Nay vote.

January 23rd 2007      Baldwin Commissioners continue their discussions

February 5th 2007      Daphne Council have been attending informal meetings about the service road

February 27th 2007      Baldwin Commissioners discuss the cost of redesigning the Interchange

March 8th 2007      Baldwin Commissioners unanimously support the Service Road

March 12th 2007      Baldwin Road & Bridge Department schedule meetings with TimberCreek and Cypress Equities

May 11th 2007      TimberCreek Land Co, agrees to contribute $4.3 million to the Service Road Project

June 8th 2007      Baldwin Commissioners discuss the TimberCreek Land Co. letter at a work session

June 14th 2007      Baldwin Commissioners pass another motion on the Service Road including the TimberCreek Land Co. contribution...

June 14th 2007      Later the same day... Allen Cox from TimberCreek Land Co. makes a presentation to Daphne Council, includng the very insightful statement that "...the 130 acres, once the interchange is completed, will be the most valuable parcel of land left in Baldwin County. " (See also the withdrawl of re-zoning request above!)

September 6th 2007      Baldwin County Budget meeting identifies a shortfall

September 18th 2007      Baldwin Commissioners revise the Service Road agreement

October 15th 2007      Allen Cox presents once more to Daphne Council

October 16th 2007      Baldwin Commissioner Burt is hoping for an agreement on the project

November 6th 2007      Baldwin Commissioners answer press questions about the service road

November 28th 2007      Allen Cox explains the funding breakdown at a Daphne Council work session

December 3rd 2007      City of Daphne Attorney ensures all the Council members have received the draft MOU for the $1 million contribution

December 17th 2007      Daphne Council approve the MOU (Gus Palumbo's Nay vote goes in vain)

2008

January 3rd 2008      Allen Cox is pressing the Baldwin Commission to get a move on

January 7th 2008      Daphne Council make progress on the MOU

January 8th 2008      Alvin Cox presents the plan to Baldwin Commissioners.  [I know his name is Allen but the court reporter got it wrong and I think it is funny!]

January 22nd 2008      Baldwin Commissioners discuss the ALDOT part of the project

February 5th 2008      Baldwin Resolution 2008-63 - Service Road Agreement with ALDOT including $1.5m funding

March 25th 2008      The project now has a number:  MJ00208

June 10th 2008      Baldwin Commissioners discus the CR-13 and I-10 Interchange

June 17th 2008      Baldwin commissioners pass reolution 2008-122 approving the construction of the CR-13 I-10 Interchange

August 7th 2008       Baldwin Budget Meeting... Now they've approved it, where is the money coming from? 

December 8th 2008       At a Baldwin Road and Bridge Committee meeting there is the first hint that the infirmary may not be coming

2009

January 20th 2009      Baldwin Commissioners try to get $8m of stimulus money for the Service Road project

March 16th 2009      Baldwin Road and Bridge Committee hear that the environmental document has been approved but there's still that doubt about the infirmary

August 13th 2009      The Corps of Engineers seem to be bogging down the project [good] and the budget deliberations continue

November 24th 2009      The delays mean Baldwin Commission has to agree amendments with TimberCreek Land Co and Cypress Equities

December 8th 2009      TimberCreek Land Co flex their muscles with the Baldwin Commission while Cypres Equities drage their feet

December 15th 2009      The amendments are finally approved; TimberCreek Lands Co's is contingent on them getting a good price from ALDOT for the land needed for the Interchange

2010

March 8th 2010      Daphne Council recognizes that the infirmary is not going to be built and that the road will have no benefit to the City

March 25th 2010      Hundreds of TimberCreek residents attend Daphne Planning Commission to complain about the sub-division, illegal sale and potential for the Magnolia 9 being turned into commercial property

April 5th 2010      Daphne Council realize they don't actually have a "Golf Course" zone

April 13th 2010      TimberCreek Residents question why Baldwin County is going ahead despite the infirmary being cancelled

April 19th 2010      Daphne Council withdraw their support of the service road and put the re-zoning map on hold

April 20th 2010      Another large turn out from TimberCreek residents to see the Baldwin Commission cancel the Service Road project.  Hooray!

April 22nd 2010      Daphne Planning Commission reject the application for sub-division, effectively making the sale illegal as the probate judge could only ratify the transaction with Daphne Council approval

April 27th 2010      Baldwin Commissioners conduct a post mortum on the project

    I was curious about why Mr. Allen Cox's role in all of this seems to be to the detriment of the neighborhood he helped to create and has assumedly already profited from. A quick search turned up this article from 2007, in which he says, referring to the 40 acres of real estate along the proposed service road that he owns:

    “That will probably become the most expensive piece of property in Baldwin County,” Cox said.

    Well, that statement cleared it up nicely for me! I think I'm all caught up now!

    But seriously, thank you for your dedication to saving our investments. Having recently purchased my dream home, I appreciate this forum and the opportunities it provides me in protecting it.
